OVERVIEW
These Terms and Conditions govern your use of the Immersive Group website and the provision of our services. By accessing our website or engaging our services you agree to be bound by these terms. If you do not agree, please discontinue use immediately.
OUR SERVICES
Immersive Group provides projection mapping, LED video wall solutions, brand activations, permanent installations, 3D content creation, event production and consultation services. The specific scope, deliverables, timeline and investment for any project will be agreed in writing prior to commencement via a separate project agreement or proposal document.
ENQUIRIES AND PROPOSALS
Submitting an enquiry through our website does not constitute a contract or commitment on either side. A project only becomes contracted once both parties have signed a written agreement and any required deposit has been received.
All proposals, concepts and creative documents submitted to prospective clients remain the intellectual property of Immersive Group until a formal agreement is in place and payment has been received.
PAYMENT TERMS
Unless otherwise agreed in writing, our standard payment structure requires a deposit prior to commencement of work, a second instalment at an agreed project milestone, and final payment prior to delivery or go-live. Specific terms will be outlined in your project agreement.
Late payments may incur interest in accordance with applicable law. We reserve the right to pause or suspend work on a project where payment obligations have not been met.
INTELLECTUAL PROPERTY
All creative concepts, designs, animations, content and technical work produced by Immersive Group remain our intellectual property until full payment has been received. Upon receipt of final payment, agreed usage rights are transferred to the client as specified in the project agreement.
We retain the right to document, photograph and use any completed project in our portfolio, marketing materials and press unless explicitly agreed otherwise in writing.
CLIENT RESPONSIBILITIES
Clients are responsible for providing accurate briefs, timely feedback and approvals within agreed timeframes. Delays caused by late client input may affect delivery timelines and could result in additional costs, which will be communicated in advance.
Clients are responsible for obtaining any necessary permissions, licences or permits required for their venue or event, including location rights, music licences and local authority approvals unless otherwise agreed in the project scope.
CHANGES AND CANCELLATIONS
Any changes to an agreed project scope must be submitted in writing. Significant changes may affect cost and timeline and will be quoted accordingly.
In the event of cancellation by the client, any work completed and costs incurred up to the point of cancellation will be invoiced. Deposit payments are non-refundable unless cancellation is due to a material breach by Immersive Group.
If Immersive Group is unable to fulfil a project due to circumstances beyond our reasonable control, we will notify the client as soon as possible and work to agree an appropriate resolution.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Immersive Group shall not be liable for any indirect, incidental, special or consequential damages arising from the use of our website or services. Our total liability in connection with any project shall not exceed the total fees paid by the client for that project.
Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.
CONFIDENTIALITY
Both parties agree to keep confidential any sensitive business information shared during the course of a project and not to disclose it to third parties without prior written consent, except where required by law.
FORCE MAJEURE
Neither party shall be held liable for failure to perform obligations under these terms where such failure results from circumstances beyond reasonable control, including but not limited to natural disasters, government restrictions, power failures, pandemics or acts of terrorism.
GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise agreed in writing.
CHANGES TO THESE TERMS
We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our website or services following any changes constitutes acceptance of the revised terms.
